This document refers to the conditions under which the website www.exploringmallorca.com can be used. By accessing or using the website www.exploringmallorca.com, you agree to the terms and conditions below. This website is owned and managed by Rom Contur Concept SRL
User rights:
The user of www.exploringmallorca.com has the right to view the website on a computer monitor, print parts of the website content on paper and save pages in electronic format for personal, non-commercial purposes only.
Obligations of the user of www.exploringmallorca.com: You agree to comply with the following obligations including (but not limited to):
-financial responsibility for all transactions carried out on your account or in your name.
- you are over 18 years of age and have the legal capacity to initiate legal actions- -guarantee the veracity of the data provided about you or your family members. - not using the Site for speculative purposes, generating false or fraudulent reservations.
-Prohibition of transmitting political, pornographic, racist or other materials that violate the law
- The obligation not to alter, copy, transmit, distribute, sell, license or reproduce the content of the Site except for the personal and non-commercial use of a single copy of the information contained in the Site.
The user of www.exploringmallorca.com does not have the right to use (in existing or modified form) the content of the site for commercial purposes. The user of www.birouldeturism.ro does not have the right to remove the copyright notice and/or registered trademark from copies of the content. Copies will be made only in accordance with the terms of use. The user of www.exploringmallorca.com does not have the right to create databases or manuals by downloading page by page of the content of the site. Booking Conditions
1. About these terms
1. When you complete your Booking, you accept these Terms and any other terms provided to you during the booking process.
2. If any authority decides that any of these terms are illegal, the remaining terms will continue to apply.
3. If there is any inconsistency between the general and specific terms, the specific terms will apply.
2. About ExploringMallorca.com
2.1. When you book a service, accommodation, Rom Contur Concept SRL provides the Exploringmallorca.com Platform and is responsible for it, but does not provide the Travel Experience itself and is not responsible for it (see point A3.4 below).
2.2. We collaborate with companies that provide local support services (for example, customer support or account management). These companies do not:
control or manage our Platform
have their own Platform
have no legal or contractual relationship with you
provide Travel Experiences
represent us or enter into contracts or accept legal documents on our behalf
act as “agents for the communication of procedural documents” for us.
3. Our Platform
3.1. We obtain information from Service Providers and cannot guarantee the accuracy of all information, but when providing our Platform, we exercise reasonable caution and act with professional diligence. Unless we have acted negligently or intentionally, we cannot be held liable for any errors, interruptions or missing information. We will of course do our utmost to correct/remediate them as soon as we become aware of them.
3.2. We always strive to improve our customers’ experience on Booking.com. As such, we sometimes present different designs, wordings, products, etc. to different people to see how they react. As a result, you may not encounter some services or conditions when you access our Platform.
3.3. Our Platform does not constitute a recommendation or endorsement of any Service Provider or its products, services, facilities, vehicles, etc.
3.4. We are not a party to the terms entered into between you and the Service Provider. The Service Provider is solely responsible for the Travel Experience.
3.5. To make a Booking, please ensure that all of your information (including payment and contact details) is correct and up to date, otherwise you may find that you are unable to access your Travel Experience(s). You are responsible for anything that happens to your Account, so do not let anyone else use it and keep your username and password secret.
3.6. We will present the offers available to you in (what we believe is) the language that is right for you. You can change the language at any time.
3.7. Unless otherwise stated, you must be at least 18 years of age to use the Platform.
4. Our Values
1. You are required to:
comply with our terms
comply with all applicable laws
cooperate with any fraud/money laundering checks we may need to carry out
not use the Platform to cause nuisance or make false Bookings
to use the Travel Experience and/or the Platform in accordance with their intended purpose
not cause nuisance or damage and not behave inappropriately towards the Service Provider’s staff (or anyone else, for that matter).
5. Prices
5.1. When you make a Booking, you agree to pay the cost of the Travel Experience, including any applicable fees and taxes.
5.2. Obvious errors and typographical errors are not binding. For example: if you book a premium car or a night in a luxury apartment that was mistakenly offered for €1, your Booking may be cancelled and we will refund any amount you have paid.
6. Payment
6.1. For certain products/services, the Service Provider will require an Advance Payment and/or a payment debited during your Travel Experience.
If we arrange your payment, we (or, in certain cases, our affiliate) will be responsible for processing your payment and ensuring that your transaction is completed with our Service Provider. In such case, your payment constitutes final settlement of the price “due and payable”.
If the Service Provider collects the amount from you, this will be done in person at the start of your Travel Experience, but it is possible (for example) that your credit card will be charged at the time of booking or that you will pay at the time of check-out from the Accommodation. This depends on the Service Provider’s Prepayment policy, as communicated to you during the booking process.
6.2 If the Service Provider requires a Prepayment, it may be debited or pre-authorized when you make the Booking and may be non-refundable. So, before booking, please review the Service Provider’s Prepayment policy (available during the booking process), which we have no control over and are not responsible for. This provision does not affect your rights if you have any issues with your Travel Experience.
6.3. If your payment method is in a currency* different from the currency of payment, your bank or payment method provider (or their payment service providers) may charge you additional fees. For example, this could happen if your credit card is in euros but your hotel charges you in dollars. If this happens, we will inform you during the booking process.
* Refers only to the default currency of your payment method.
6.4. If you are aware of or suspect any fraudulent behavior or unauthorized use of your Payment Method, please contact your payment service provider as soon as possible.
6.5. If the currency selected on the Platform is not the same as the Service Provider’s currency, we may:
display prices in your currency
offer you the option to Pay in your currency.
7. Policies
7.1. When you make a Booking, you accept the applicable policies as displayed during the booking process. You will find the cancellation policy and any other policies of each Service Provider (regarding age requirements, security/damage deposits, additional supplements for Group Bookings, extra beds, breakfast, pets, accepted cards, etc.) on our Platform: on the Service Provider’s information pages, during the booking process, in the small print and in the confirmation email or ticket (if applicable).
7.2. If you cancel a Booking or do not show up, any cancellation/no-show fees and any refunds will depend on the Service Provider’s cancellation/no-show policy.
7.3. Some Bookings cannot be cancelled free of charge, and others can only be cancelled free of charge up to a certain deadline.
7.4. If you book a Travel Experience by paying in advance (including all components of the price and/or a damage deposit, if applicable), the Service Provider may cancel the Reservation without notice if it is unable to collect the balance by the specified date. In the event of cancellation by the Provider, any non-refundable payment you have made will be refunded at the sole discretion of the Service Provider. It is your responsibility to ensure that payment is completed on time (that your bank or debit or credit card details are correct and that there are sufficient funds in your account).
7.5. If you do not believe you will arrive on time, please contact the Service Provider and let them know when you expect to arrive. It is your responsibility to ensure that you arrive on time – if you do not arrive on time, we are not liable for any associated costs (for example, cancellation of your Reservation or any fees that the Service Provider may charge).
7.6. As the person making the Booking, you are responsible for the actions and conduct of all persons in your group (in relation to the Travel Experience). You are also responsible for obtaining their permission before providing us with their personal data.
8. Privacy and Cookies
8.1. If you are booking an accommodation or an attraction, please see our Privacy and Cookies Statement for further information on privacy, cookies and how we may contact you and process your personal data.
9. Accessibility Requests
9.1. If you have any accessibility requests:
about our Platform and/or services, please contact our team.
about your Travel Experience (wheelchair access, disabled bathtubs, etc.), please contact the Service Provider.
10. Communication with the Service Provider
10.1. We may assist you in communicating with your Service Provider, but this does not mean that we assume responsibility for the Travel Experience or for what the Service Provider does/does not do. We cannot guarantee that the Service Provider will read what they receive from you or that they will do what you ask them to do. The fact that you contact them or that they contact you does not in itself mean that you have grounds for legal action. If you need assistance, please contact us through our Help Center.
